LemanProSail Privacy Policy

1. Introduction
Shady Gawad (“we”, “our” or “us”) operates the LemanProSail mobile application (the “Application”). This Privacy Policy explains how we collect, use, disclose and protect your information when you use our Application. Please read this Privacy Policy carefully. If you do not agree with the terms of this Privacy Policy, please do not access the Application.
2. Applicable legal framework
The processing of personal data carried out within the Application is subject to:
- the Swiss Federal Act on Data Protection (nFADP) of 25 September 2020, in force since 1 September 2023;
- the General Data Protection Regulation (GDPR, EU 2016/679) for users residing in the European Economic Area (EEA).
3. Information we collect
We may collect information about you in various ways when you use LemanProSail. The information we may collect includes:
Personal data: Demographic and other personally identifiable information (such as your name and email address) that you voluntarily provide to us when creating an account, configuring your boat profile or managing your crew.
Location data: To provide our core features, we collect precise geolocation data from your device. This is necessary to compute routes on Lake Geneva, track your sailing sessions in the logbook and provide real-time tactical data during regattas. You can enable or disable location services while using our Application at any time, through your device settings.
Boat and performance data: Information about your vessel, including boat models, polars and session history (miles sailed, routes taken).
Derived data: Information that our servers automatically collect when you access the Application, such as your native actions that are integral to the Application, including waypoint placement, route computation or interaction with the weather data map.
4. How we use your information and legal bases for processing
Having accurate information about you allows us to provide you with a smooth, efficient and personalized experience. Specifically, we may use the information collected about you through the Application to:
- Compute optimal sailing routes using your boat’s polar and external weather data (e.g., MeteoSwiss).
- Create and manage your account and your crew profiles.
- Compile your personal sailing logbook and track your regatta performance.
- Facilitate communications between users, such as sharing routes or session data with your crew.
- Monitor and analyze usage and trends to improve your experience with the Application.
- Notify you of Application updates.
In accordance with the GDPR and the nFADP, each processing activity relies on a legal basis:

5. Disclosure of your information
We do not sell your personal data. We may share the information we have collected about you in certain situations:
With your crew: If you use the crew management and session sharing features, the relevant trace data and logbook entries may be shared with the designated users.
Third-party service providers: We may share your information with third parties that provide services for us or on our behalf, such as web hosting and data analysis. Hosting of the Application and its data is provided by Netcup GmbH, whose servers are located in Germany (European Union). These providers act as processors and are bound by contractual commitments compliant with the GDPR.
By legal obligation or to protect our rights: If we believe that disclosing information about you is necessary to respond to legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property and safety of others.
6. Publication of data in the context of regattas
When you take part in a regatta or record a session associated with a racing event, certain of your data may be published and made accessible to third parties — including the regatta organizers, other participants and, where applicable, the public — via race-tracking tools, rankings, dashboards or regatta replays.
The data that may be published in this context includes:
- GPS traces (latitude, longitude, speed, heading, altitude, timestamp);
- Boat name, boat type or model, sail number, bow number;
- Team or crew name;
- Race times and performance data related to the event.
The purpose of this publication is the proper running, refereeing, live tracking, broadcasting and analysis of the regatta. It relies on the performance of the contract (Art. 6.1.b GDPR), on the legitimate interest of the organizer and participants in ensuring the running and broadcasting of the event (Art. 6.1.f GDPR) and, where required, on your consent (Art. 6.1.a GDPR).
Your email address and your account information are not published in the context of regattas.
7. Data retention and security
We use administrative, technical and physical security measures to help protect your personal information. Although we have taken reasonable steps to secure the personal information you provide to us, please note that despite our efforts, no security measure is perfect or impenetrable. We retain your personal data, including logbook traces, only for as long as necessary for the purposes set out in this Privacy Policy, subject to legal retention obligations. Upon deletion of your account, all associated personal data is erased within a reasonable period.
8. Your data protection rights
Depending on your place of residence, including under the Swiss Federal Act on Data Protection (nFADP) and the General Data Protection Regulation (GDPR), you have the following rights regarding your personal data:
- the right of access to the personal data we hold about you;
- the right to rectification of inaccurate data;
- the right to erasure (“right to be forgotten”), including your account and your logbook history;
- the right to restriction of processing;
- the right to data portability;
- the right to object to processing based on legitimate interest;
- the right to lodge a complaint with a supervisory authority (the Federal Data Protection and Information Commissioner — FDPIC — in Switzerland; the CNIL in France, or any other competent authority in the EEA).

9. International data transfers
Your data is primarily hosted within the European Union, with our hosting provider Netcup GmbH (Germany). Where certain data may be processed by providers located outside Switzerland or the European Economic Area, we ensure that such transfers are governed by appropriate safeguards, such as the European Commission’s Standard Contractual Clauses and, where applicable, the Data Privacy Framework.
10. Minors
The Application is intended for users aged 16 years or older. Users under the age of 16 may only use the Application with the prior and verifiable consent of their parents or legal guardians. Any data collected about a minor without the required consent will be deleted upon request.
11. Changes to this Privacy Policy
We may update this Privacy Policy from time to time. We will notify you of any changes by updating the “Effective date” of this Privacy Policy. We encourage you to review this Privacy Policy periodically to stay informed of updates.
